Summary of Affected Activities Requiring the NPDES Stormwater Permit Ref. 40CFR122.26(b)(14)(i)-(xi)
There are 12 general types of “activities” affected by the full Stormwater Regulation:
(i) Facilities subject to stormwater effluent limitations guideline, new source performance standards, or toxic pollutant effluent standards (see 40CFR subchapter N):

(iii) Mineral Industry:
Including active and inactive mining operations.

(iv) Hazardous Waste:
Hazardous waste treatment, storage, or disposal facilities including those operating under interim status or a RCRA permit
(v) Landfills:
Landfills and other sites that receive or have received industrial waste
(vi) Recycling:
Facilities involved in the recycling of materials, ie metal scrap yards, battery reclaimers, salvage yards, and auto junkyards
(vii) Steam Electric Plants:
Steam electric power generating plants, including coal-handling sites
(viii) Transportation:
Facilities classified by the following SIC codes which have vehicle maintenance shops, equipment cleaning operations, or airport de-icing operations:

(ix) Treatment Works:
Works treating domestic sewage or any other sewage sludge or wastewater treatment device or system
(x) Construction:
Operators of construction site activities that result in a land disturbance of 1 acre or more
(xi) Light Industry:
Facilities classified by the following SIC codes

(xii) Operators of small Municipal Separate Storm-water Sewer Systems (MS4)
Check the regulations for exact or specific language, exceptions, and optional “No Exposure” Exemptions.
“No Exposure” means all industrial materials and activities are protected by a storm resistant shelter to prevent exposure to rain, snow, snow-melt, and/or runoff.
Drums, barrels, tanks and similar containers that are tightly sealed do not automatically require storm resistant shelters provided that those containers are not deteriorated and do not leak. This is basically for fresh containers.
“Sealed” means banded or otherwise secured and without operational taps or valves. Opened containers are going to be affected.
This does not mitigate or reduce EPA spill containment regulations, but rather enhances it.
